Before you can make an application to SACAT, check that we can resolve your matter first.

Tenancies:

Landlords, agents and tenants can both make applications to SACAT to resolve issues with their tenancy agreements.  This may include where the tenancy is managed by the South Australian Housing Trust in certain cases.

Common applications include:

  • Ending a tenancy because of a breach
  • Taking back possession of a rented property after a tenancy has ended
  • Resolving disputes about possessions left behind at a rented property
  • Resolving issues with a tenancy where there is domestic violence

Rooming houses, residential parks and retirement villages:

Occupants and operators of rooming houses and residential parks can make a number of similar types of applications to those under a tenancy agreement.

Operators and residents of retirement villages may also apply to SACAT to resolve disputes regarding:

  • Breach or failure to comply with a residence contract
  • Harsh or unconscionable conduct by an operator
  • Payment of an exit entitlement

What SACAT can assist with:

  • Appointing a guardian or administrator
  • Varying or revoking a guardianship or administration order
  • Making orders about a guardian’s powers
  • Providing advice, direction or approval to a guardian or administrator on the exercise of their powers
  • Providing consent to certain invasive medical treatment
  • Resolving disputes regarding Advance Care Directives in some circumstances

What SACAT can't assist with:

  • Making or changing a power of attorney
  • Making or changing a will
  • Changing a decision made by a guardian or administrator
  • Resolving a complaint about a residential facility

SACAT can hear and determine disciplinary applications for a range of professions and occupations. These are usually to decide if a person has committed professional misconduct.

SACAT can also hear applications to review licensing, registration and accreditation decisions for a number of professions.

What SACAT can assist with:

  • Resolving a dispute between parents about a child's name
  • Approving an application by a parent to change a child's name
  • Approving an application by a child or their parent to the Registrar to register a change of the child’s sex or gender identity
  • Approving an application by a child or their parent to the Registrar for an identity acknowledgement certificate
  • Reviewing a decision of the Registrar to reject an application to register a change of sex or gender identity where the number of applications exceeds the limit published by the Registrar

What Births, Deaths and Marriages can assist with:

  • Applications to change the name of a child where both parents consent and/or jointly apply
  • Applications to register a birth in South Australia
  • Applications to register a death (SACAT may order registration of a death or the inclusion/correction of registrable information)
  • Applications to register a change of a child’s sex or gender identity (SACAT may approve an application made to the Registrar)
  • Applications for an identity acknowledgement certificate (SACAT may approve an application made to the Registrar)

Administrative reviews

SACAT is able to conduct reviews of certain decisions made by agencies and organisations in the South Australian government, including some decisions of Local Councils.

Equal opportunity

You cannot apply directly to SACAT to resolve an equal opportunity complaint. Instead, the Commissioner for Equal Opportunity may refer your complaint to SACAT where:

  • They have attempted to conciliate the matter and are unsuccessful
  • They are of the view that the matter cannot be resolved by conciliation
  • They decline to recognise the complaint and the complainant has requested the complaint be referred to SACAT
  • They are of the opinion that the matter should be transferred to SACAT

You can only make an application directly to SACAT to review the Commission's refusal of an application for an extension of time to lodge a complaint.
