Housing and rentals

SACAT deals with housing disputes including those involving residential tenancies , retirement villages, residential parks and rooming houses.

Please note, the below is not a comprehensive list. You should seek legal advice to determine whether you can make an application to SACAT.

  • An order for compensation or a claim on the tenant's bond (please see the CBS website (external site) (external site) first for more information about bond refunds)
  • An order to take back possession of a rented premises after the end of a tenancy
  • An order ending a tenancy agreement for the following reasons:
    • Frustration (for example, the property has been destroyed)
    • Hardship
    • The tenant's conduct is affecting the neighbours or the property is being used for an illegal purpose
    • The tenant is committing a serious breach (for example, failing to pay rent, causing serious damage to the premises or personal injury)
  • An order for a tenant to remedy a breach (for example, to keep the property in a reasonable condition and reasonably clean)
  • A declaration that the landlord is not in breach, or has remedied a breach, and reinstating a tenancy (where the tenant has terminated the tenancy agreement by issuing a notice)
  • A declaration that rented premises are abandoned and an order to take back possession
  • An order for compensation or a claim on the bond (please see the CBS website (external site) (external site) first for more information about bond refunds)
  • An order for the landlord to remedy a breach (for example, to carry out repairs)
  • An order to end a tenancy agreement due to hardship, frustration or breach of the tenancy agreement
  • A declaration that the tenant is not in breach of the tenancy agreement, or has remedied a breach, and an order reinstating a tenancy (where the landlord has terminated the tenancy agreement by issuing a notice)
  • An order to end or change a tenancy agreement due to domestic violence
  • Resolution of disputes about property left behind after a tenancy has ended
  • An order requiring the tenant's information be removed from a residential tenancy database

A tenant of the South Australian Housing Trust or a Community Housing Provider may make some of the same applications to SACAT as a tenant in a private tenancy agreement.

SACAT may also review certain decisions of the South Australian Housing Trust in relation to your tenancy.
