Applications for Exemptions from a Provision of the Equal Opportunity Act 1984

From 2 September 2019, an individual or an organisation can apply to SACAT to be exempted from complying with a certain part of the Equal Opportunity Act 1984.

SACAT is required to give notice of applications to the general public.

Any person who wishes to make a written submission to the Tribunal in relation to the application for exemption should contact the Tribunal registry, to notify the Tribunal of their intention to make a submission.

Upon making a prior appointment with the Tribunal Registry a copy of the application can be inspected prior to hearing.

The Applicant, Fernwood Women's Health Clubs (Australia) Pty Ltd has applied to the South Australian Civil and Administrative Tribunal for an exemption from Part 3, Division 2, Section 30, 31 and Part 3, Division 5, Section 39 and Part 9, Section 103 of the Equal Opportunity Act 1984 (SA). The exemption is sought for a period of three (3) years.

 

The exemption is sought to permit the Applicant to create and maintain women-only fitness clubs, granting women opportunities to reach fitness goals without feelings of embarressment or self-conciousness potentially created when training in the presence of men. Some women may also wish to excerise in the absence of men for religious or psychological reasons.

The exemption would also facilitate the Applicant's continuing provision of programs and seminars designed specifically for women. 

 

Any person who wishes to make a submission to the Tribunal in relation to the application for exemption should contact the Tribunal Registry. Written submissions should be provided to the Registry by close of business on 24 August 2021.
