Public notices of exemption applications

SACAT is required to give notice of applications to the general public.

Anyone can then make a written submission to SACAT in relation to the application. SACAT then conducts a public hearing to determine whether it is necessary and appropriate for an exemption to be granted.


APPLICATION FOR RENEWAL of EXEMPTION (from a provision of the Equal Opportunity Act 1984)

Applicant: RAYTHEON AUSTRALIA PTY LTD

The Applicant, RAYTHEON AUSTRALIA PTY LTD has applied to the South Australian Civil and Administrative Tribunal for an exemption from section 52 and 54 of the Equal Opportunity Act 1984 (Act). The exemption is sought for a period of three (3) years.  

An exemption has previously been granted under the same provisions of the Act, the most recent being by the South Australian Employment Tribunal on 30 June 2023.  The Applicant seeks an exemption from sections 52 and 54 of the Act as a result of:  

  • the work it completes, which requires access to sensitive defence-related materials (including articles, services, technology and information or data) controlled by the United States (U.S.)   Government (U.S. Export Controlled Material); and 
  • steps it must take to ensure it complies with the requirements of the U.S. Government to allow   it to access this sensitive material, including the requirements of the International Traffic in Arms Regulations and the Export Administration Regulations or other regulation to similar effect, as amended from time to time, so far as they apply to U.S. Export Controlled Material used in the Applicant's operations.
