Applications for Exemptions from a Provision of the Equal Opportunity Act 1984

From 2 September 2019, an individual or an organisation can apply to SACAT to be exempted from complying with a certain part of the Equal Opportunity Act 1984.

SACAT is required to give notice of applications to the general public.

Any person who wishes to make a written submission to the Tribunal in relation to the application for exemption should contact the Tribunal registry, to notify the Tribunal of their intention to make a submission.

Upon making a prior appointment with the Tribunal Registry a copy of the application can be inspected prior to hearing.

The applicant, WALLMANS LAWYERS, has applied to the South Australian Civil and Administrative Tribunal for an exemption from compliance with the provisions of Section 52 of the Equal Opportunity Act 1984.

 

An exemption is sought insofar as this section relates to the “race” (as defined in Section 5(1) of the Act) of applicants for employment, employees, and contract workers.

 

The above application will be heard at 1.30pm on Monday 11 November 2019 on Level 7, 100 Pirie Street, Adelaide, South Australia.

The Applicant, THE MINISTER FOR EDUCATION OF SOUTH AUSTRALIA, has applied to the South Australian Civil and Administrative Tribunal for an exemption from the provisions of section 37 (1) and (2) and section 39 (1) of the Equal Opportunity Act 1984 for a period of three (3) years.

 

An exemption has previously been granted under the same provisions of the Act mentioned above, the most recent being by the Equal Opportunity Tribunal on 14 November 2016.

 

The exemption is sought to enable ongoing provision of education only to female students at the girls’ education campus of the Roma Mitchell Secondary College, which will enhance the learning environment and educational opportunities of present and future female students, particularly those students from disadvantaged backgrounds.
