Applications for Exemptions from a Provision of the Equal Opportunity Act 1984

From 2 September 2019, an individual or an organisation can apply to SACAT to be exempted from complying with a certain part of the Equal Opportunity Act 1984.

SACAT is required to give notice of applications to the general public.

Any person who wishes to make a written submission to the Tribunal in relation to the application for exemption should contact the Tribunal registry, to notify the Tribunal of their intention to make a submission.

Upon making a prior appointment with the Tribunal Registry a copy of the application can be inspected prior to hearing.

The Applicant, LEIDOS AUSTRALIA has applied to the South Australian Civil and Administrative Tribunal for exemption from sections 52, 53, 54  and 103 of the Equal Opportunity Act 1984 (SA) insofar as they relate to the ‘race’ of the Applicant’s employees and contractors.

 

The exemption is sought for a period of three (3) years.

 

The Applicant submits that it requires the proposed exemption to be able to comply with the laws of the United States of America governing access to certain defence-related technology and data which the Applicant requires for performing contracted works for the Commonwealth of Australia, in particular the Department of Defence.

 

Any person who wishes to make a submission to the Tribunal in relation to the application for exemption should contact the Tribunal Registry. Written submissions should be provided to the registry by close of business on 7 August 2020.
